Halle Berry’s ex-boyfriend Gabriel Aubry’s appeal to ditch nanny supervised visits with daughter Nahla, has been rejected by court.
According to TMZ.com, Gabriel was trying to amend his visitation rights, which requires a nanny to be present while he’s with Nahla — claiming he wanted more alone time with his daughter. Halle had opposed the change.

But the supermodel’s request has been shot down by the judge, who issued an order upholding the original agreement requiring supervised visitation, TMZ.com reported. Aubry is said to be very angry and feels that the nanny is ruining his relationship with his daughter.

A British ferry crashed into a French fishing boat killing its skipper because the crew were discussing how 'sexy' Halle Berry looked in the movie Catwoman.

The French fishing vessel was sliced in two by the force of the collision in thick fog between St Helier in Jersey and St Malo, France, on March 28 this year.

A damning report into the crash has revealed that the 56-year-old French captain of the high-speed Condor Vitesse catamaran joked with colleagues about the Hollywood actress as the passenger vessel travelled across the channel at full speed in poor visibility.

The investigation also disclosed that the captain and crew failed to spot the boat on two separate radar screens.

And French marine accident investigators also discovered that the ferry's fog horn had been turned off because it was thought that the sound of the vessel's engines would be enough to warn craft in the surrounding area.

A transcript of the conversation on the bridge of the Condor Vitesse showed that crew had no idea that danger was imminent.

Minutes before the fatal impact with the whelk fishing boat Les Marquises, the ferry's unnamed master said to colleagues: 'Yesterday evening I watched Catwoman on the TV. I'm an idiot because after that I slept very badly.'

The first officer replied: 'Catwoman?'

The master said: 'She was jumping from everywhere like a cat. She is very beautiful. She was wearing sexy outfit.'

The conversation turned went on to talk about drug testing and how long various substances remained in the body.

They only learned there was a problem when a leak alarm on the ferry went off.

The 30ft boat was broken in two in the collision, sending her three crew into the water. Her captain Philippe Claude Lesaulnier, 42, was killed.

The master then announced to the 194 passengers on board: 'Your attention please, this is an announcement from the bridge, we have collided a foreign body in the water, perhaps a little piece of wood or a pot buoy, we'll investigate and we'll inform you.'

A passenger, however, had seen the collision from the deck and informed the crew that he thought they'd collided with a fishing boat.

The report by the French investigation body BEAmer, found the ferry was travelling at 37 knots, almost top speed for the vessel, and had not strengthened look-outs in the fog.

The report stated: 'In the wheelhouse almost continuous talking without any link to the watch-keeping, maintained an atmosphere not compatible with the necessary concentration to conduct a high speed craft in the fog.'

It added: 'This behaviour, as well as the visibility contributed to the accident.

'When Condor Vitesse approached the Minquiers waters, both officers did not detect two vessel echoes ahead on starboard, the first was a ship that would be passing a hundred metres on starboard, the second was Les Marquises.'

In its findings the report also explained what happened in the final moments on the fishing boat before the collision.

Out of the fog one of the deck hands 'suddenly heard an engine noise very close' and alerted his colleague who shouted at the skipper 'Full astern, full astern'.

The same deckhand watched in horror as the massive ferry appeared quickly from the fog on a collision course with the wheelhouse of the smaller boat.



Simon Edsell, managing director of Condor Ferries, based in Poole, Dorset, said: 'Condor Ferries welcomes the publication of the BEAmer report into this this tragic accident.'

He said the master and first officer had been relieved of their duties following the crash and that other investigations were continuing.

A man accused of showing up at Oscar-winning actress Halle Berry's Hollywood Hills home for three days in a row in July has been ordered to stand trial.

Richard Anthony Franco, 27, has been charged with on one count each of stalking and residential burglary.

Los Angeles Superior Court Judge Melissa N. Widdifield denied a defense motion to dismiss the case against Franco who is currently jailed on $150,000 bail.

Berry was not called to testify during the hearing, which included testimony from a security guard who worked for the actress and a Los Angeles police detective who spoke to Berry on July 12, one day after Franco's arrest.


LAPD Detective John Gregozek told the judge of Berry's response said: 'She was afraid for her safety and that of her daughter, as well.'
'She hired armed security to stay at her residence 24 hours.'
Berry said she had initially seen the intruder while she was in her kitchen with her manager on July 9, and her manager went outside and told him to leave, and that she saw him again the next day after she went into her kitchen to get something to drink, the detective testified.

Gregozek added: 'She saw the defendant standing at the kitchen door,' noting that Berry told him that she locked the deadbolt on the kitchen door and ran upstairs to call 911.

The detective testified that Berry told him she realized that a key that had been attached to a keychain in the door to a room she uses as a beauty salon was missing, and showed him a key and keychain that were similar to the ones later recovered from Franco following his arrest.

Another prosecution witness, Joseph Vach, testified that he was working as a contract guard at Berry's residence July 11 when he saw a man he identified as Franco try to climb over the fence, fall backward and then vault over the fence in his second try.

He said police were called and Berry was notified to get to a safe place.

Berry was asked to walk outside the home to identify Franco, the security guard testified.


Franco was carrying a notebook that mentioned the actress by name, Vach testified.

Under cross-examination, the security guard said he did not know who had written in the notebook.

Franco, who has been barred from coming within 500 yards of Berry and her home, is due back at the downtown Los Angeles courthouse on October 31 for arraignment.

Halle Berry may have been in pain as she hobbled along on crutches but it was not going to stop her taking her daughter out for a treat.

The 45-year-old actress broke her foot last week during a mis-step on the island of Mallorca, Spain.

And although she looked to be in discomfort, the devoted mother limped through an afternoon out with Nahla and friends earlier today.

The make-up free star looked pale and drawn as she made her way through the cobbled streets.

Dressed in an orange and brown patterned mini dress her surgical boot which encased her injured leg was clearly visible.

The Oscar winner went to a local restaurant and then treated the three-year-old to a large ice cream cone.

A concerned Nahla also made sure her mother was alright as they crossed a busy street later on.

The adorable tot skipped along wearing a red floral dress and white sandals and was delighted when she got to tuck into the large creamy treat.

Halle had been racing around the streets of Glasgow, Scotland earlier this month doing her own stunts in an action scene.

But just a few days later she broke her foot at her Spanish rented villa during a day off from filming her new movie Cloud Atlas.

TMZ reported: 'She heard a crack and then felt the pain. Halle went to the hospital, where doctors put her foot in a cast. She was taken out of the hospital in a wheelchair.'

The accident has put her film bosses in a spin, with sources saying they plan to shoot around her injury by shooting her from the waist up and use a stunt double.

It is understood that other scenes which do not feature Halle have also been brought forward.

Warner Brother released a statement which said: 'Halle Berry suffered a foot injury today while walking in Mallorca on a day off from filming Cloud Atlas.

'Production has adjusted their schedule and will continue filming.'

Halle is among an ensemble cast starring in the big-screen adaptation of David Mitchell's novel Cloud Atlas - a collection of six different stories set between the 19th century to the post-apocalyptic future.

She plays journalist Luisa Rey who investigates reports of corruption and murder at a nuclear power plant.

A host of A-listers are taking part, including Tom Hanks, Susan Sarandon, Hugo Weaving and Hugh Grant.

This month Halle has also spent time in Mallorca with her boyfriend Olivier Martinez as part of her European stay.
