Halle Berry can breathe a sigh of relief today after a man convicted of stalking her was put behind bars.

Richard Franco was given a 386-day prison sentence in Los Angeles on Thursday, according to showbiz website TMZ.com

But the 27-year-old will be a free man in just six months even though he was arrested for scaling the wall of her Hollywood Hills property.

The obsessed fan - who has already spent 193 days in custody - reached a plea agreement with prosecutors.


In exchange for pleading no contest to felony stalking, they agreed to drop a felony burglary charge.

He was then sentenced to 386 days in jail and, because he has already served half that time, he will be released in about six months.

It has been a scary scenario for the 45-year-old single mum, who has a three-year-old daughter.

The July 2011 incident was the THIRD time the man tried to trespass on the Oscar winner's property in a single weekend.

He was finally arrested after her private security team - who are off-duty police officers - saw him climb over the back wall of her property and allegedly attempt to enter a guest house.

A month later a judge granted the actress a three-year restraining order against Franco, which has since been extended to ten years.

He must stay at least 200 yards away from the actress and her daughter Nahla for the next decade.

After he is released he will have to do five years probation and complete a one-year psychological programme.

The twice-divorced actress is currently dating French actor Olivier Martinez.

The couple have denied reports that they are engaged.
