It seems Halle Berry has been left disappointed in her efforts to stop her former lover Gabriel Aubry from seeing their daughter.

For RadarOnline are reporting a judge concurred with the opinion of social workers that the hunky Canadian should be allowed to continue unsupervised visits with three-year-old Nahla.

The decision comes after Los Angeles Department of Children and Family Services investigated claims the model had assaulted the girl's nanny.

She claims she went to pick Nahla up at school, and she was not there because Gabriel, 36, had kept her home sick for two days, and that he pushed her when she confronted him about it.

A source said: 'Social workers recommended that absolutely no changes be made in the current custody agreement, which the judge gives tremendous weight and consideration to.

'Halle and Gabriel essentially have joint custody of Nahla.

'DCFS found absolutely no basis to the claims that Gabriel physically assaulted the nanny, or has ever physically abused Nahla.

“There was nothing found to substantiate the nanny's claims, and social workers felt that a restraining order that Halle was seeking wasn't necessary, and would actually harm Nahla by keeping her from her father.'

The decision followed him facing off against his former lover in court on Monday.

Gabriel seemed buoyant today as he was spotted walking with the ambrosial youngster, carrying her along with her bag as he dropped her off at school.

However he is not out of the woods yet in regards to their ongoing legal feud over the future custody arrangements for the youngster.

The former couple were advised by a judge to to take parenting classes together to try and sort out their differences for the sake of their daughter.

Nahla is also thought to have been recommended to have counselling by the Family Services department.

Investigators think the former couple's daughter could benefit from such sessions.

A source told RadarOnline: 'The report recommends that Halle and Gabriel attend parenting classes together, so that they can co-parent Nahla together.

The classes will give them the tools to work through their issues, and hopefully become better parents for it.'
At the time of the incident two weeks ago a source claimed Aubry had angrily shoved the worker when she arrived to take his daughter back to Halle.
The source said: 'She picked up Nahla to leave and Gabriel yelled at her and shoved her out the door so hard that she hit the wall - while she had Nahla in her arms!'

However Gabriel strenuously denied the charges and voluntarily sat down for a formal interview with the police.
Meanwhile Halle Berry looked far from cheerful as she went for lunch with her latest squeeze Olivier Martinez.
The crocked 45-year-old looked glum as she struggled to get out of their car as the productive pair went for a bite at a swanky eatery in West Hollywood.
