Oscar winner Halle Berry's ex made 'completely and totally unacceptable' racial slurs against the actress - and dyed their six-year-old daughter's hair blonde, it was revealed in court today.

The star took her former love, Gabriel Aubry, to court, accusing him of straightening their little girl Nahla's naturally curly hair and lightening it over the past year in a bid to deny her African-American heritage.

As a result, Halle said in court documents, Aubry had caused Nahla 'potential psychological and physical damage' - and could cause her to wonder 'why her natural appearance is not good enough'.

A judge ruled today that neither Halle nor Aubry can now change Nahla's hair, while court records obtained by MailOnline show that Aubry has made shocking racist remarks against the star.

In a note included on Halle's testimony to the court about her ex's 'reprehensible' actions, she referred to the findings of Los Angeles County Superior Court Judge Mark Juhas, who presided over their recent custody case.

He said: 'The racial epithet made by Petitioner was and is completely and totally unacceptable.

'Nahla is a child of both of these parents, making this sort of comment about Respondent affect the very core and being of Nahla.

'And when Petitioner attacked Respondent for what she is and who she is, he was attacking Nahla because Nahla is part Respondent. And Nahla is part Petitioner. So when Petitioner did those things, that does serious damage to Nahla because he is attacking her core being, who she is.'

Today, a source close to Halle told MailOnline Gabriel had used racially abusive language to Halle - claiming he called her the N word - but said: 'Halle is a great mom, she wants to keep Nahla on an even keel.'

Describing Halle's fears over Nahla's hair, the source said: 'Halle kept asking and asking Gabriel about Nahla's hair and he kept denying it.

'What does this say to a six year old who’s half black? Her father is denying her identity.

'Halle then filed the court papers and Nahla's curls came back.'

In her testimony, Halle said: 'I strongly feel that Gabriel's same underlying attitude is at the root in the changes which only he could have been causing to our daughter's hair.'

She told how she had secured scientific evidence to prove she is not 'delusional', as Gabriel had called her, 'about the extensive damage and the changes to the texture and color of Nahla's hair that were observed by me. I was not willing to allow this to be a 'he said-she said' dispute.'

The actress told how she had collected Nahla's hair with a new brush and sent the strands from June 28, 2014, to a laboratory.

She said she first noticed a difference in her daughter's hair when Nahla returned from visiting her father in August 2013, saying : 'Gabriel continues to maintain that he has done and is doing nothing to cause the extensive straightening, color changes, stripping and damaging of our daughter's hair.

'I have personally observed the changes in Nahla's hair texture and color over the last year. I have never personally experienced hair damage nor have I ever known a single person whose hair has suffered such excessive changes from spending time in a salt water pool (or even chlorinated water) and sunlight.'

Halle put forward 'before and after' photos of Nahla to the court and said: 'I have since reviewed the laboratory report concerning this very hair sample that I obtained, which confirms to me that Gabriel has not been truthful about what he has done and had been doing to our daughter's hair.'

The star's mother Judith is white and originally from Liverpool in the UK, while her father, Jerome Jesse Berry is of African-American heritage.

And she noted: 'I continue to worry about the potential psychological and physical damage to Nahla that can be caused by the use of chemical hair treatments and the psychological message that it conveys to Nahla, and to implore the court to put a stop to Gabriel's attempts to alter our daughter's appearance and most probably cause her to wonder why her natural appearance is not good enough.'

This is the latest court battle for Halle and Aubry, who split in 2010 after four years together, leading to a lengthy custody dispute over Nahla. In 2012, Halle was banned from moving with Nahla to France, where she said they would have more privacy.

The pair are currently in court as Halle - who became the first the first African American woman to win an Oscar for best actress for Monster's Ball in 2002 - is seeking to cut her monthly child support payments to Aubry.

She is making a bid to reduce her monthly payments from about $16,000 to $3,800. But Aubry claims he needs the money because he was unable to book modeling jobs after he came to blows with Halle's husband, French actor Olivier Martinez on Thanksgiving 2012.

For her part, Halle alleges that Aubry uses the child support for his own fitness, clothing, electronics, car and health insurance, TMZ has reported.

Halle and Martinez, 48,married in July 2013 and welcomed son Maceo-Robert that October.

Halle was not at court in Los Angeles on Monday morning, but her lawyer Steve Kolodny was present, along with Gabriel.

The source said: 'When Halle has a problem, she just goes to court to settle it. Nahla is a great little girl, and they are incredibly close.

'Nahla is always foremost in her mind.'

In the court papers, Halle said she was keen to work together with Gabriel, adding: 'I want both Gabriel and I to make decisions together that affect our daughter, her growth, her development and her general welfare...

'I continue to hope that Gabriel and I can find a way to work together to be successful co-parents. It was with regret that I concluded that I had to seek the court's intervention on these issues, but until Gabriel recognizes the meaning of joint legal custody and how it is implemented, it appears that hte court will be my only resort to safeguard Nahla's best interests.'

Olivier Martinez has been busy playing the doting dad to stepdaughter Nahla while new wife Halle Berry takes some time out of the spotlight following the October 5 birth of the couple's son.
But the new father no doubt gave himself a bit of a shock when he was involved in a minor fender bender in a supermarket car park in Los Angeles on Sunday with the five-and-a-half-year-old in the car.
The French actor was dropping the youngster off with friends when his SUV was sideswiped by another four wheel drive at Ralph's in Studio City.

Close call: The rear left door of the 47-year-old's white SUV took the brunt of the impact, which appeared to be the side of the car Nahla was sitting on

Though no-one was hurt and the damage was only minimal, the 47-year-old and the female driver of the other car diligently swapped insurance information and took photos on their mobile phones before going their separate ways.
In fact, once he had evaluated the damage and checked to make sure Nahla was safe and sound, the Taking Lives star laughed off the incident, even sharing a joke with the blonde, who was appearing concerned and a little flustered.

It's unclear whether or not she was aware that she had hit an A-lister, as Olivier was dressed down for the outing and somewhat unrecognisable with his greying locks and facial hair.
The star was wearing cuffed jeans, brown shoes, a bright orange Broncos Super Bowl T-shirt and black leather jacket, while he partially obscured his face under a navy blue baseball cap.
When all the commotion settled, little Nahla, who is Halle's daughter with ex-boyfriend Gabriel Aubry, was taken from the scene by the family friend.

Halle, 47, has yet to be seen since welcoming son Matteo less than two months ago, likely waiting until she's in fighting fit form before she subjects herself to public scrutiny, much like Kim Kardashian did following the June birth of daughter North.

She announced her pregnancy earlier this year and has been relishing every second of it.
Proud of her growing belly, Halle Berry showcased her burgeoning bump in a clinging maxi dress as she stepped out in Malibu, California over the weekend.
On Monday, however, the 46-year-old actress slipped into full-on maternity frock to pick up her daughter Nahla from school in Los Angeles.

At first, the dress appeared to be just your average short-sleeved tunic frock, but as it got caught in the wind, it was clear that the piece was specially constructed for a mother-to-be.
As extra air flowed up the frock, the dress gave the illusion of a ready-to-pop baby bump.
Still showing a sense of style, the X-Men star sported a pair of bedazzled black sandals on her feet.

After picking up her little one, the two made a shopping trip to Bel Bambini, a luxury baby boutique in West Hollywood.

Later, she got to be in charge of her own mini shopping cart that she gladly filled to the brim with toys and clothes.

Halle teamed her maxi dress with flip flops and sunglasses as she and Olivier dined at Geoffrey's restaurant.
Chatting to her dining companions after the meal, Halle beamed with delight as she enjoyed the conversation, keeping one hand on her stomach the entire time.

Earlier this month, Halle admitted that conceiving a baby with Martinez was a 'miracle'.
She told ET Online: 'I'm thinking that this is a miracle. I feel really happy. It's one of the best things that happened in my life, for sure.'
The baby, a boy, will be the first for 47-year-old French actor Olivier, and the second for Halle, who is already mother to five-year-old Nahla with ex Gabriel Aubry.

'Seeing Nahla happy is all that matters to Gabriel.'

Halle Berry is reportedly pregnant with her second child.

The 46-year-old Oscar-winning actress and her French fiance Olivier Martinez are having their first child together, according to TMZ.

The pair already share partial custody of Halle's five-year-old Nahla, whom she had with former boyfriend Gabriel Aubry.

The Oscar winner is reportedly three months pregnant, and being done with her first trimester, already knows the sex of the child.

Soon-to-be-big sister Nahla will be sharing her mother's love with a baby brother, according to sources.

Halle and Olivier, 47, have yet to confirm the rumours.

She did nothing to prevent speculation though when she was on holiday in Hawaii last week, resorting to cover-ups whenever she stepped out on the sand with her family.

Last fall she opened up to Wendy Williams about adding to her family, saying that Nahla had expressed wishes of being a big sister.

'My daughter is asking me,' she said.

'Every night we pray to God, and she's so sweet. She says, "God, please bring me a bunk bed and a baby sister." And I say, "I can do one of those things, I know for sure! The other one we have to keep praying on." What do you say to her when she wants that and can't understand why God's taking so long, you know?'

The admission was ominous for the famously private actress, who also said that she has learned a lot since giving birth to her daughter five years ago.

'I'm a much better mother at 46, or 41 when I had her, than if I were 21 or 25. I was just a little baby, just trying to figure it out, trying to figure out who I was, let alone have the responsibility of trying to help another little soul develop and grow,' she admitted.

'I'm so glad I waited.'

Halle has been incredibly protective of her brood, fending off photographers as they came too close for comfort upon their return to Los Angeles on Tuesday.

She restrained her fiance and pushed him into their waiting car after a paparazzo accused him of pushing him at Los Angeles International Airport.

The incident happened when the French actor was trying to navigate his way out of the terminal while carrying Nahla after they arrived back from a break in Hawaii.

Halle became hysterical as they attempted to leave the area amid dozens of camera flashes and pleaded with photographers to leave them alone.

After a photographer told her "he pushed me," she replied: "There is a child. There is a child here, that's why you idiots."

This is not the first public brawl for the couple, who have been involved in a nasty court battle over daughter Nahla with her French Canadian ex.

Last November, Olivier entered into a violent brawl with Gabriel, 36, after he dropped her off at the Halle's home.

They reached a mutual decision not to pursue criminal charges and to settle the dispute amongst themselves for Nahla's sake after Gabriel originally filed for a restraining order against Olivier, claiming he had threatened to kill him.

The row stemmed from Gabriel blocking Halle from moving to France with their daughter to escape attention from the media.

A judge ruled that the pair could not move because it would prevent Gabriel from being able to see his daughter regularly.

Halle still maintains that a move to Paris in the near future, though it may be years away.

The actress said in an interview with HELLO! magazine: ‘It will probably won’t be until my daughter is 18 and off to college.

‘When Nahla turns 18, she’ll be legally able to make her own decisions about where she wants to be and I think that then, when she’s off on her own, we’ll move there. It’s where I want to end my days, that’s for sure.’

She admitted that she loves her four-year-old so much that she's prepared to dress up like a giant cupcake to take her trick or treating on Halloween night.
So it's perhaps understandable that Halle Berry, 46, looked a little downcast in Beverly Hills today as she spent time alone while daughter Nahla saw her father.

The pixie-haired beauty – who is engaged to actor Olivier Martinez - is locked in a bitter custody battle with ex-partner Gabriel Aubry.
Halle is believed to be waiting to discover if she can get her little one to live with her in France along with Martinez.
But for now, she must allow her youngster to spend time with the French Canadian model.

On Sunday, Nahla was spotted riding a horse at the farmers’ market in Studio City, California.

Sources tell the website that both Halle and Gabriel's lawyers have closed their cases and are waiting for the judge's decision.
The former couple may also appear in court as the judge has apparently said that he doesn't want to send a written decision to the pair's respective lawyers.

Yesterday she was the sexy girlfriend zooming around town on the back of Olivier Martinez's motorbike.
But today Halle Berry was back in full mummy mode as she took little daughter Nahla on a trip to the pumpkin patch in Beverly Hills.
The actress kept it low key and casual in black trousers and boots and a white shirt under a big grey hoodie.

She completed the look with giant sunglasses and very soft, muted makeup.
Meanwhile two-year-old Nahla looked incredibly sweet in her little ladybird raincoat and with her face brightly painted.

At one point, 44-year-old Halle got a yellow cart to pull the pumpkins around in.
And Nahla, too tired to walk anymore, decided to ride in the cart with all the pumpkins.

Both mother and daughter were clearly enjoying their quality time, as recently Halle has been spending a lot of time with Martinez.
The couple went riding around Los Angeles yesterday on Martinez's bike, complete with a police cavalcade.
The police accompanied the VIP's for a short distance before leaving them to it.
And when the pair hit traffic, Martinez managed to maneovre his way through the cars with no effort at all.

The Oscar winner began dating the French actor a month after meeting on the set of their upcoming film Dark Tide in South Africa.

A source tells People magazine, 'It was a big deal that Olivier got to meet Halle's mom. It shows that they are getting more serious.'

Halle's new relationship comes in the wake of her split from her boyfriend of five years, French-Canadian model Gabriel Aubrey.

She put in a glamorous appearance at the Spike TV Scream awards over the weekend in a sexy gold sequined mini dress. she has also been promoting her new perfume, Reveal, this month in Europe.
