Celebrity parents have cause to celebrate in California today.
A bill meant to deter paparazzi from getting too close to the children of famous folks was signed into law by Gov. Jerry Brown in Sacramento.
Both Halle Berry and Jennifer Garner had testified on behalf of Senate Bill 606, which increases the possible punishment for harassing celebrity kids—and clarifies the legal definition of harassment in such cases.
Now, according to the office of state Sen. Kevin de León, who sponsored the bill, harassment includes "conduct in the course of the actual or attempted recording of children's images and/or voices, without express parental consent, by following their activities or lying in wait."
Meanwhile, transmitting, publishing or broadcasting a child's image and/or voice does not constitute a violation.
Now, if shutterbugs are convicted of harassing a minor who has been targeted based on his or her parent's employment (i.e. famous actor, singer, personality, et al.), they can spend up to a year in jail instead of the previous maximum six months, and be fined $10,000 for their first violation, $20,000 for their second and up to $30,000 for their third.
"Kids shouldn't be tabloid fodder nor the target of ongoing harassment," de León said in a statement. "SB 606 will give children, no matter who their parents are, protection from harassers who go to extremes to turn a buck."

The law also makes it easier for a parent or legal guardian to sue a pap for damages over an incidence of harassment.
Berry has been seen more than once giving photographers a piece of her mind when they've come too close to comfort to her and daughter Nahla.
"I started this fight with a great deal of hope and a bit of uncertainty so I cannot express my immense gratitude that Gov. Brown has recognized, and acted to remedy, the plight of children who are tormented because of the identity or prominence of their parents," the star said in a statement. "On behalf of my children, it is my hope that this is the beginning of the end for those overly aggressive paparazzi whose outrageous conduct has caused so much trauma and emotional distress."
The Oscar winner also thanked her legal team and some fellow famous moms who threw their support behind the bill.
"I am forever in awe of the support I got within my community from the enormously talented musician Adele to fellow actor Jennifer Garner who traveled with me to Sacramento to share her children's stories, experience and her desire to give them a better life," she continued.

"I'm grateful to Nia Vardalos and the numerous parents who work as actors, musicians, as well as professionals in medicine, mental health, lawyers, judges and cops who have experienced their children being harassed, tormented or otherwise put in dangerous situations due to their parent's profession and therefore lent their support. It is for all of us that I rejoice today and hope that this fight will continue and that the proper enforcement of this law will truly make a positive impact on the daily lives of all children."
Garner said while testifying before the California State Assembly Committee on Public Safety last month that, while she chose by way of her career to have a "public life," her three children with Ben Affleck are "private citizens."
"They're beautiful and sweet and innocent, and I don't want a gang of shouting, arguing, lawbreaking photographers who camp out everywhere we are all day, every day, to continue traumatizing my kids," the Dallas Buyers Club star said.
Garner recently turned the tables on a paparazzo, stopping to snap a pic of him with her phone when he stopped to shoot video of her and her kids at an L.A. farmers market.

Halle Berry: Paparazzi Told My Daughter, ‘You May Not See Your Father Again’

Aug 13, 2013 3:03pm
Halle Berry and Jennifer Garner appeared at the California State Capitol today to testify before the Assembly Judiciary Committee in support of a new bill that would modify the definition of harassment and, they believe, better protect their children.
Berry, 46, has a 5-year-old daughter, Nahla, with her ex-boyfriend Gabriel Aubry and is expecting her first child with her new husband, French actor Olivier Martinez. The Oscar-winning actress said thatduring a custody battle over Nahla  in which Aubry blocked her from moving to France with Martinez, paparazzi baited the child with taunting questions.
“‘How do you feel, Nahla? You may not see your father again. How do you feel about that?’” Berry said they would ask her child, adding that she had hoped to move to Europe to escape the constant media glare. “They say curse words and call me names, all trying to provoke some sort of response to sell a photograph.”
Naturally, her daughter is confused by the attention, and “doesn’t want to go to preschool anymore” because she’s always trailed, Berry said.
She’d ask, “‘Why did they say that to me, mommy? What does that mean? Who are these men and why are they following us?’” Berry said, before introducing fellow celeb mom Jennifer Garner. “We aren’t just whiny celebrities. … We’re moms who are just trying to protect our children.”
Garner, who said that a threatening stalker once trailed her with a crowd of photographers and hid behind her daughter’s school, cried when discussing the treatment of her family.
“I chose a public life … [but] my three children are private citizens,” she said. “I love my kids. They’re beautiful and sweet and innocent, and I don’t want a gang of shouting, arguing, lawbreaking photographers who camp out everywhere we are all day every day to continue traumatizing my kids.”
After a  lengthy debate, the bill passed.
“I hope this is a nice gift to you from this committee,” Bob Wieckowski, California State Assembly member and chairman of the committee that passed the bill, told Berry, acknowledging her birthday on Wednesday.
The bill now heads to the Appropriations Committee.

Garner and Halle Berry, left, testified before the Assembly Judiciary Committee in support of a bill that would limit the ability of paparazzi to photograph children of celebrities and public figures.
SACRAMENTO, Calif. - Actresses Halle Berry and Jennifer Garner urged California lawmakers Tuesday to support legislation that they say would help them better protect their children from the paparazzi that follow them daily.
The stars testified before the Assembly Judiciary Committee regarding SB606, which would impose tougher penalties on photographers who harass celebrities and their children.
It was Berry's second state Capitol appearance on the measure. The Academy Award-winning actress, who is pregnant, told lawmakers the constant presence of photographers yelling and snapping pictures has made her daughter scared to go to school.

"As mothers, as parents, we don't have the wherewithal or the law in place right now to protect them from this," Berry said. "What this bill would do is give us our rights back so that we can protect our children."
The bill from Sen. Kevin de Leon, D-Los Angeles, would change the definition of harassment to include photographing or recording a child without the permission of a legal guardian by following the child or guardian's activities or by lying in wait. It also increases the penalties for people convicted of such behavior.
The bill passed the panel without opposition and now heads to the Appropriations Committee.
Garner, who starred in the ABC series "Alias," nearly cried describing how paparazzi aggressively follow her and her three young children as she takes them to school and to the pediatrician.
She told the committee that she understood she would make certain sacrifices when she chose a career in acting but that her children have not made the same decision to be in the public spotlight.
"I don't want a gang of shouting, arguing, law-breaking photographers who camp out everywhere we are, all day, every day, to continue to traumatize my kids," Garner said.
Media organizations are concerned the bill will restrict journalists who are conducting legitimate newsgathering activities.
Joe Berry of the California Broadcasters Association said harassment is already illegal. The legislation "is overly broad and overly reaches in order to rein in these bad actors," he testified.
De Leon told the committee he believes pending amendments will satisfy some concerns about the bill.

Sexy Halle Berry, 46, upstages Katherine Heigl, 33, in the battle of the little black dress

Sexy Halle Berry, 46, upstages frumpy Katherine Heigl, 33, in the battle of the little black dress

There’s a 13-year difference between the two actresses.

And while Katherine Heigl may have age on her side, Halle Berry proved that she has far more wisdom when it comes to style at an LA event on Friday.

The 46-year-old screen star trumped the 33-year-old when they both attended Variety’s 4th Annual Power of Women event wearing similar dresses.

The pair both stepped out in black numbers with a square-shaped bust line.

But while Berry – who turned up with fiancé Olivier Martinez - put her cleavage on display in the lower cut item, also letting her pins go bare, Heigl opted to remain a little more modest.

The blonde – who was earlier spotted catching a limousine to the venue wither mother – covered her legs in unflattering nude tights and her neckline rose a little higher than Halle’s.

They weren’t the only ones opting for a light hue - Queen Latifah, Sarah Paulson and former Desperate Housewives actress, Felicity Huffman, played with the theme but featured black detail in their attire.

Mother-of-three Jennifer Garner, kept her look mature and sophisticated, tying her brunette locks back and wearing an earthy tint.

Her husband, Ben Affleck, and Warner Bros. President of Worldwide Marketing, Sue Kroll, enjoyed a sweet moment as he bent down to hug her.
